BeVouched Terms of Service
Effective date: October 13, 2026
1. The agreement
These Terms of Service ("Terms") are a contract between you and Dana Digital Corporation, a Wyoming corporation ("BeVouched", "we", "us"), 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, United States. They govern the BeVouched app for iPhone and Android, the website at bevouchedapp.com and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Community Guidelines (bevouchedapp.com/legal/community-guidelines), which are part of them; our Privacy Policy (bevouchedapp.com/legal/privacy) explains how we handle your information. If you do not agree, do not use the Service. Section 14 explains how disputes are resolved.
2. What BeVouched is
BeVouched lets you record where you have worked, ask coworkers who were there at the same time to confirm it, connect with them, and give and receive vouches: short, positive statements about someone's work from a person who saw it. BeVouched is not an employer, staffing agency, background-check or employment-verification service (Section 11).
3. Eligibility
You must be at least 18 years old, able to form a binding contract, and not barred from using the Service under applicable law. The Service is intended for people in the United States; if you use it from elsewhere, you are responsible for complying with local law.
4. Your account and phone number
- You sign in with your mobile phone number and a one-time code we send by text message; carrier rates may apply. By giving us your number you agree to receive sign-in codes and service messages by text. We do not send marketing texts.
- Sign in with Apple or Google, where offered, is also subject to their terms.
- Keep your phone number and device secure; you are responsible for everything done through your account. If you lose control of your number or suspect misuse, tell us at support@bevouchedapp.com.
- One account per person, in your own name, with accurate profile information; do not create accounts for others, share yours or hold more than one. If your number changes, contact us.
5. Acceptable use
BeVouched only works if what people add is true. You agree that you will:
- add only jobs you actually held, at the real business, with accurate months, and mark a job remote only if you worked it remotely;
- confirm a coworker only when you really worked at the same place at the same time, and answer "Not sure" or "The dates are off" when that is the honest answer;
- write vouches only about work you personally observed and believe to be true. Vouches are positive-only by design and must not contain false statements, defamation, threats, harassment, hate, sexual content or discrimination, or comments about someone's body, background, beliefs or private life;
- use your real name, and not impersonate anyone or claim a job, title or relationship you did not have;
- not harass, intimidate, stalk or bully anyone, including through repeated requests or invitations;
- not post confidential information about an employer, its customers or coworkers, or anyone's private information (home address, phone number, immigration status, health);
- not buy, sell, trade or solicit vouches, confirmations, connections, points or badges, or add fake or deliberately duplicate businesses or alter business records to mislead;
- not use bots, scrapers or other automated tools, reverse engineer the app, probe or bypass our security, rate limits or privacy rules, or interfere with the Service or other members' use of it;
- not use the Service for anything unlawful, including decisions regulated by the Fair Credit Reporting Act (Section 11);
- not upload content you have no right to share, including someone else's photo as yours, or content that infringes anyone's intellectual property or privacy.
6. Confirmation requests and false claims
- When two members log months at the same business that overlap by at least 14 days, the Service creates a confirmation request between them. Each answers independently: "Yes", "No", "Not sure" or "The dates are off". An uncompleted request expires after 30 days.
- Your answer is private; the other person sees only waiting, confirmed or expired. Only a "Yes" from both people creates a confirmed coworker link, with a connection, points and the "Verified coworker" mark on vouches between you. If either person changes dates so the periods no longer overlap, the request is withdrawn.
- Confirming someone you did not work with, or claiming a job you did not hold, is a serious breach of these Terms. We may remove the entry, the confirmation and any vouches that depend on it, take back points and badges, limit features, suspend or close the account and, where appropriate, tell the people affected, acting on reports, patterns of use or other information in our own judgement.
7. Your content and the license you give us
You keep ownership of everything you add to BeVouched ("Your Content").
So that we can run the Service, you grant Dana Digital Corporation a worldwide, non-exclusive, royalty-free license, sublicensable to our service providers, to host, store, copy, adapt (for example to resize a photo), display and distribute Your Content to operate, improve, secure and promote the Service, including on profile, business and invite pages and in link previews according to your visibility settings. The license lasts while Your Content is on the Service and afterwards only for backups, records we must keep and content others have already received. We will not use your name or photo in advertising without your separate permission.
Business records you created stay after you leave; vouches you wrote are hidden when you delete your account; vouches about you are deleted with it. You can retract a vouch within 24 hours; after that it stays unless our team removes it or your account is deleted. The person a vouch is about cannot edit it and may report it.
You are responsible for Your Content and confirm that you may share it, that it is accurate, and that it breaks neither these Terms nor anyone's rights. We may use suggestions you send us without obligation.
8. Points, streaks and badges
Points, levels, streaks, shields and badges are a reward program for honest use of the Service. They have no monetary value, are not property, cannot be bought, sold, transferred or redeemed for cash or anything else, and may be adjusted, taken back or removed at any time, including when earned by breaking these Terms. We may change how they are earned, or end the program, at any time; referral rewards depend on activation conditions we set.
9. Invitations and sharing
- You may invite people to BeVouched by share link. The invitation is sent by you, from your own phone, through the messaging app you choose; you, not we, are the sender. We do not read your contacts.
- Invite only people you have the right to contact and who would reasonably welcome the message, such as coworkers you actually worked with; never strangers or purchased lists. You are responsible for complying with laws on unsolicited messages, including the Telephone Consumer Protection Act.
- We may limit how many invitations you can send and disable invitations for accounts that misuse them. Profile links and invite pages are public; sharing a link makes that page visible to whoever receives it, subject to the profile's visibility settings.
10. Reports, blocks and enforcement
- You can report any profile, job, vouch, business or confirmation from the app, and block any member. Blocking hides you from each other everywhere and withdraws any open confirmation between you. We do not tell a person who reported them.
- Reports are reviewed by people. We may do nothing, ask for more information, remove or hide content, take back points or badges, limit features, or suspend or close an account; serious cases, such as threats or impersonation, may be closed right away. We may also act without a report.
- Knowingly false reports, and retaliation against someone for reporting, violate these Terms.
- We cannot promise to act on every report or explain every decision. If you think we got it wrong, write to support@bevouchedapp.com and we will look again.
11. Disclaimers
Not an employment-verification service. BeVouched is not a background-check, employment-verification, screening or credential service. Confirmations and vouches are statements by other members; we do not verify them and do not guarantee that any work history, confirmation or vouch is accurate, complete or current. Business records are entered by members and may be wrong or duplicated.
Not a consumer reporting agency. BeVouched is not a consumer reporting agency under the Fair Credit Reporting Act ("FCRA"), and nothing on the Service is a "consumer report". You may not use information from the Service to decide anyone's eligibility for employment, credit, insurance or housing, or for any other purpose covered by the FCRA or similar state laws.
As is. The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, error-free or secure or that content will be preserved; some jurisdictions do not allow these exclusions. We are not responsible for the conduct of any member, on or off the Service, or for any decision made based on content from the Service.
12. Limitation of liability
To the fullest extent the law allows:
- Dana Digital Corporation, its officers, directors, employees, contractors (including the studio that builds the Service) and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, employment opportunities, goodwill, data or reputation, arising out of the Service or these Terms, under any theory of liability.
- Our total liability for all claims arising out of the Service or these Terms will not exceed the greater of what you paid us in the previous twelve months and one hundred US dollars (US $100).
- These limits apply only as far as your state's law permits and do not limit liability that cannot be limited by law, such as for fraud.
13. Indemnity
You agree to defend, indemnify and hold harmless Dana Digital Corporation and the people and companies listed in Section 12 from any claim, loss, liability, cost or expense (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, your breach of these Terms, or your violation of any law or anyone's rights, including by posting false work history, a false confirmation or a false or defamatory vouch, or by inviting people you had no right to contact. We may take over the defense of any such claim, and you will cooperate with us.
14. Dispute resolution and governing law
Talk to us first. Before starting any formal proceeding, send a written description of the dispute to support@bevouchedapp.com or our address in Section 1 and give us 60 days to resolve it informally; we will do the same before bringing a claim against you.
Governing law. These Terms and any dispute between us are governed by Wyoming law and applicable federal law, without regard to conflict-of-law rules.
Arbitration. If informal resolution fails, any claim arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small-claims court or ask a court for an injunction against misuse of intellectual property or unauthorized access to the Service. The Federal Arbitration Act governs this clause. The arbitrator applies Wyoming law and may award the same relief a court could award to an individual, by telephone, video, written submissions or in person in your county. We will pay arbitration fees above what a court filing would cost you unless the arbitrator finds your claim frivolous.
No class actions. You and we agree to bring claims only individually, not as a plaintiff or class member in any class, consolidated or representative proceeding, and each of us waives any right to a jury trial. If this waiver is unenforceable for a claim, that claim proceeds in court, not arbitration.
Opt-out. You may opt out of arbitration by emailing support@bevouchedapp.com within 30 days of first accepting these Terms with your name and phone number. If you opt out, or a court decides this clause does not apply, disputes will be heard exclusively in the state or federal courts in Sheridan County, Wyoming, and you consent to their jurisdiction.
15. Termination
By you. Delete your account at any time from Settings; your profile is hidden immediately and your data is purged after 30 days, as described in the Privacy Policy.
By us. We may suspend or close your account, or restrict features, if we reasonably believe you have broken these Terms or the Community Guidelines, if the law requires it, or if we discontinue the Service, and will tell you unless doing so would be unlawful or unsafe.
Effect. When your account ends, your right to use the Service and the license in Section 7 end, except as stated there. Sections 7 (as to retained content), 8, 11, 12, 13, 14 and 17 survive.
16. Changes to the Service and to these Terms
We may add, change or remove features and limits at any time, and may discontinue the Service with reasonable notice. We may update these Terms: we will post the new version at bevouchedapp.com/legal/terms with a new effective date and, for material changes, tell you in the app or by text message at least 14 days before they take effect. Using the Service after that date means you accept the new Terms; if you do not agree, delete your account before then.
17. App stores and general terms
Apple and Google. The App Store and Google Play terms also apply. Apple and Google are not parties to these Terms, have no obligation to support or maintain the app, and are not responsible for any claim relating to it, including product-liability, consumer-protection and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; otherwise these Terms create no rights for anyone other than you and us.
Electronic communications. We may give you notices in the app, by text message, or by email if you have given us one.
General. These Terms, the Community Guidelines and the Privacy Policy are the entire agreement between you and us about the Service. If any part is unenforceable, the rest remains in effect; not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of the business. You may not use the Service from a country under a United States embargo or if you are on a United States restricted-party list.
